Frequently Asked Questions

The rules and policies presented here in a question and answer format have been approved by the DMMA Board of Directors and express the intent of the Board. They are subject to change by the DMMA Members or the Board as allowed by the rules of the DMMA Governing Documents (Articles of Incorporation, Bylaws and Design Review Guidelines). Members are bound by the Governing Documents and you should understand them before joining. Additional copies are available from the Director of Community Relations.

Membership & Annexation Process

Q1: We own a condominium along with several other families. Can we annex our property to DMR and become members of DMMA?

A1: YES. Annexed property owned by multiple individuals will have one DMMA membership attached to it. The owners of the property must name one person to represent the property in all matters of DMMA.

Membership cards allowing full use and benefits of all DMMA amenities will be issued to the person designated as the representative of a property owned by several owners and his or her spouse and legal dependants.

The Board has adopted a rule that will allow up to three additional individuals, who are also owners of the annexed property, their spouses and dependent children to be issued recreation passes to use the Purgatory Village Community Center, Cascade Village pool and spa. The rights of holders of a facilities pass may be limited or restricted as determined by the Board, at its discretion. Also, the benefits extended to holders of a facilities pass do not include those benefits that may be offered to DMMA members, such as discounts at DMR retail shops and restaurants.



Q2: The title to our unit is in the name of a corporation, trust or other entity. Can we join the DMMA, and if we do, are all of the principals of the corporation eligible for membership?

A2: YES. You may join the DMMA but the entity will hold the DMMA membership. Annexed property owned by an entity will have only one DMMA membership attached to it. The entity must name one person to represent the entity in all matters with the DMMA. To enjoy the benefits of membership in DMMA, a trust must designate a trustee as the entity representative.

If additional cards are issued to other parties listed in the trust or corporation, please refer to policies listed above.



Q3: What is the process for annexing our property and thus, joining the DMMA?

A3: To qualify for annexation a Membership Application and Annexation Agreement must be signed by each owner of the property. If the Membership Application is received prior to December 31, 2002, no application fee will be due. If the application is received on or before April 15th, 2003, there will be a $500 initiation fee. After April 15th, 2003, a 2% transfer fee will be required to join DMMA. This transfer fee is determined by the appraised value of your property. Subsequently, legal documents will be prepared for your signature and notarized prior to filing.



Q4: We own a condominium along with several other families. If one of us sells our interest, how is the RETF (real estate transfer fee) determined?

A4: If any party sells their share, then only that share is subject to the RETF, which is based on the “consideration” paid for that share.



Q5: Our children are named on the title to our unit. If we join DMMA, will our children have to pay the RETF (real estate transfer fees) when we die?

A5: No, pursuant again, to the Bylaws of DMMA, (paragraph D, “Consideration” subparagraph (E), any transfer of title or change of an interest in the property by reason of death, whether determined in a will, trust or decree of distribution is otherwise exempt.

Any change in the ownership of the property by reason of the property passing upon death would be exempt, whether it is 100% of the property or only a partial interest.



Q6: Our unit is held in a trust. If we join DMMA, will our children have to pay the RETF when we die?

A6: No. As mentioned above, any transfer, whether outright or in trust, that is for the benefit of the transferor or his relatives, but only if there is no more than nominal consideration for the transfer, is exempt. A distribution from a trust shall be treated as a transfer made by the grantors of the trust, in proportions of their respective total contributions to the trust.

Q7: When someone purchases a DMMA property, can the RETF be financed?

A7: Generally, yes. The RETF must be paid at the closing of the sale, and as such may be financed by the lender and will be subject to any conditions imposed by the lender.



Q8: Will there be a cost associated in recording the annexation of my property to DMMA? If so, who will be responsible for this cost?

A8: Yes, the cost is minimal to record the Annexation Agreement, and will be paid by DMMA.



Q9: Once we join the DMMA and annex our property, can we later change our minds and “de-annex?”

A9: No. The DMMA is a Homeowner’s Association, which benefits residents of a community while they own their property. Those benefits are then transferred to a new buyer at the closing of a sale. While it is theoretically possible to de-annex property, doing so would only be at the sole discretion of the DMMA Board, which would be hesitant to set any kind of precedent. The Annexation process along with the accompanying RETF is set up to allow for LONG RANGE planning for the construction and maintenance of facilities that will benefit DMMA members. Allowing for de-annexation could result in funds no longer being available to maintain facilities that are already constructed, which could then result in additional assessments for the remaining members.

Q10: I own a single-family home. Approximately, how much will my annual dues be, and how are they assessed?

A10: The annual assessment for single-family homes is determined as it is for condominium units and unimproved lots, i.e. assessments are based on their assessed value share to the total assessed value of all properties located within the DMMA boundaries. In the past, dues structures have averaged from approximately $10 - $25 per month, which is based on the assessed value of your property.



Q11: We own a condominium along with several other families. What will our annual dues be?

A11: All owners of a condominium or single family home are jointly and severally responsible for the payment of the monthly assessments for that unit. If co-owners choose among themselves to allocate partial payment of assessments to each co-owner, there will be a $5 per payment processing fee for the separate billing. Annual dues for condominiums have averaged from $96 to $240 per year, or $8 to $20 per month, based on the assessed value of your property.



Q12: We own an unimproved single-family lot and do not plan to build on it for a few years, If we join now, do we have to pay annual dues?

A12: Yes, the DMMA membership campaign also pertains to owners of unimproved lots. After April 15th, 2003, owners of unimproved lots will be responsible for the 2% transfer fee on the assessed value of the lot, and dues will be prorated from May. The dues structure of unimproved lots will be similar to those of individual condominium units, however, because dues are based on property values, the monthly fee will be substantially less than a lot with a residence.



Q13; The title to our unit is in the name of a corporation, or other entity. If we join DMMA, what will our annual dues be?

A13: The dues structure for a unit owned by a corporation is the same as for those that are individually owned. As was previously noted, only one entity of the corporation will be the DMMA member. The corporation must designate the member who will enjoy the benefits of DMMA membership.



Q14: How will I pay my annual assessments?

A14: Dues are billed annually in May, pursuant to the approval of the operating budget, for the following year.

Q15: We own a condominium and have one minor child and two married children who often like to visit. Can our married children and our grand children use the DMMA facilities?

A15: A family unit is defined as a husband and wife, and any dependant children living at home. Married children and their families will be defined as “guests” of members. These extended family members can use the Purgatory Village Community Center and may use the Cascade Village pool and spa, if accompanied by the member.



Q16: My condominium is in a rental program. Can my renters use the Community Center and the swimming pools and spas?

A16: Yes, if you as the owner, join DMMA. If rental customers make advance reservations for a DMMA unit, the rental agent will notify the hotel front desk, and upon check-in the rental customer will have the option to purchase a DMMA FACILITY PASS. The fee for this pass will be charged per room night, by the size of the unit. The fee structure per family, per day is as follows:

Q17: I frequently have guests that visit me while I am in my home. Can they use the DMMA facilities?

A17: Yes, guests can enjoy the DMMA facilities, if accompanied by the DMMA member at the Purgatory Village Community Center, swimming pool and spa.



Q18: I often let personal friends use our condominium when we are not there. Can they also use the DMMA facilities?

A18: Unaccompanied guests to your property will be viewed as rental customers when using DMMA facilities. If your personal friends/guests are staying in your unit when you are not present, they too, will have the option to purchase a DMMA FACILITIES PASS, and will be charged up front, per room night at the rates quoted above. In order to obtain electronic keys to the DMMA facilities, guests and rental customers must check in at the Purgatory Village Center Hotel front lobby to receive their key.



Q19: What proof will I have that I am a member of the DMMA?

A19: When you first join and your property is annexed, you will receive a membership “certificate” and an information sheet that includes pertinent data regarding you and your family. You can bring your membership certificate to the DMR Ticket Office, where you will receive a photo ID (very similar to the season pass) which will identify you and your immediate family members as DMMA members. This photo ID will have a computerized magnetic strip on the back that will automatically give you discounts throughout the resort, and will list other local discount programs that have been developed.



Q20: How many membership cards will we receive with our membership?

A20: You will receive one DMMA membership card for each member of your DMMA family (i.e., husband, wife and dependent children). This card must be displayed in order to receive access to the Purgatory Village Community Center, the Cascade Village swimming pool and spa, and discounts at DMR retail shops, restaurants and local VIP programs.



Q21: What are the hours of operation of the Purgatory Village Community Center?

A21: When we refer to the Purgatory Village Community Center as being “in operation”, we are speaking of the dates and hours during which the Community Center is physically staffed and the spa is open. When the Center is not “in operation”, members may still access the facility via timed electronic key systems, to use the fitness equipment. The fitness center will be available to DMMA members 365 days per year, from 6:00 a.m. – 10:00 p.m.

The Community Center is currently scheduled to be “in operation” (physically staffed) during the following calendar dates:

June 15th thru Labor Day:
11:00 a.m. – 7:00 p.m. seven days per week
 
Thanksgiving thru Easter:
11:00 a.m. – 7:00 p.m. seven days per week

All children under the age of 12 must be accompanied by an adult at the Community Center.

Keep in mind that these are suggested hours of operation, and will be subject to change as we complete the Community Center and gain experience with costs and members wishes that are associated with operations and usage. In order to use the spa at the Community Center, the center must be manned by a staff person, thus the spa/hot tub and bar/ entertainment area of the Purgatory Village Community Center will be available to DMMA members, renters and guests, only when someone is physically on site.

23: Will the Community Center be available to DMMA members for private parties/events?

A23: Yes, it will available on a limited basis to members during the winter season at $500 per day, and $250 per day during the summer season. Reservations must be made at least one month in advance through the Director of Community Relations, and will not be allowed during these major holidays: Christmas, New Years, Martin Luther King, Presidents Day, Spring Break, July 4th, Labor Day and Thanksgiving.



Q24: Is DMR and its Conference Service Division be allowed to use the Community Center for outside events?

A24: Yes, on a limited basis and upon the approval of the Director of Community Relations, the Community Center will be available for private parties and meetings. The rental income received from these private parties will go directly into DMMA. It is projected that only a limited number of outside events per year will be allowed at the Purgatory Village Community Center.



Q25: What are the other benefits to membership in DMMA, beyond use of the Purgatory Village Community Center and Eolus swimming pool and spa?

A25: The benefit program will constantly be changing and upgraded as we get more members and thus more amenities. Currently, DMMA members will receive many discounts at DMR (these will be listed on the back of the DMMA ID card), access to the North County entertainment shuttle, and will be included in the VIP area at all special events sponsored by DMR. Many local discounts at restaurants and retail shops are currently being negotiated, and will be noticed to DMMA members as the season progresses. As the Purgatory Village Community Center continues to develop, programs, services and benefits will be added to meet our growing membership needs. We invite input from all members as we grow and become a full service community.
